Before addressing the question of whether an ASADA is a public or private entity, the Lomas del Mar ASADA Board of Directors want to assure the community that we strive to comply with all Costa Rican laws and regulations. Currently, there are questions about whether extending the loop outside of the front gate makes us a PUBLIC entity and available to the greater community around us. In the following articles, you will find many examples demonstrating that we are indeed a PUBLIC organization and that ALL water in Costa Rica is considered public.
In November 2023, the ASADA had the option of either legally registering the entrance and well easements as water easements or installing a loop. Unfortunately, since these easements were NOT signed prior to this new requirement coming into force, the loop is no longer an OPTION; it is MANDATORY and is being requested of all ASADAs that do not have public access to their systems.
In summary, all ASADAs are public entities and act as administrators on behalf of AyA, not private organizations as many believe. While we report to various government organizations, AyA is considered our primary authority, and we must comply with their technical requirements to lift our status of non-technical feasibility.
Notably, 83% of the ASADA Board of Directors' members reside in Lomas del Mar, allowing us to relate closely to the community's concerns and daily worries about water. Our intent is not to harm this community; we have been transparent in our communications to ensure you are aware of our work and the reasons behind our actions.
At the General Assembly on May 28, 2025, we shared the outcome of our meeting with AyA, including changes to the "loop" requirements, and have posted updates about the start of this work.
We are committed to our community, striving to resolve issues with the ASADA despite some internal community obstacles. We aim to comply with laws while prioritizing our community.
Our new vision includes comprehensive plans to enhance infrastructure and promote growth. An AyA-approved engineer will conduct a capacity study to ensure sustainable growth without impacting current ASADA water recipients. Our Board of Directors, comprised of dedicated individuals, will only succeed with support from everyone in the community so that we can overcome the challenges together.
